Court repeals mandatory closing time for bars in Vitacura

In a divided ruling, justices of the Fourth Court have decided to uphold the request in an appeal presented by Attorney Jorge Schaulsohn against the decision made by Vitacura´s Municipal Council.

SANTIAGO. -  The Santiago Court of Appeals has ruled in favor of a request made by the owners of Vitacura pubs and bars not to enforce the recent Municipal Regulation establishing a 2:00 AM bar closing time.


In a divided ruling, judges of the Fourth Court have decided to uphold the request made in an appeal presented by Attorney Jorge Schaulsohn against the decision made by Vitacura´s Municipal Council.


Justices Lamberto Cisternas and Attorney Carlos López voted in favor of the request, while Justice Gloria Ana Chevesich was opposed to reversing the municipal order.


Unless a contrary ruling is issued in a future appeal, the restriction on bar hours stated in the Municipal Regulation will not be able to be enforced.
