Supreme Court orders municipality to pay $150 million pesos for boy’s death

Justices have decided that the family of the boy who died from electric shock should be compensated. The cause of death was determined to be the lack of maintenance of the wharf.

SANTIAGO.- The Supreme Court has ordered the Municipality of Llanquihue to pay $ 150 million pesos in damages to a woman whose son fell victim to a fatal accident on January 11th, 2003, at a pier in the town located in the Los Lagos Region.


According to the Department of Judicial Statements, the Third Court of the country’s maximum tribunal unanimously rejected the appeal presented by the municipality against the verdict reached by the Puerto Montt Court of Appeals on March 2nd, 2007 and ordered that damages be paid to María Gladys Vera Cárdenas for the emotional distress caused to her by the death of her son, Gustavo Andrés Bascuñana Vera.


The court decision indicates that the payment should be made as a result of the lack of maintenance performed on the deficient pier.


The court also established that the Municipality was the entity responsible for upkeep of the pier in question.
